Illegal: Black Sabbath MP3s online

Question:

Most people – including myself – did/do believe that it is legal to put music online if it is only 10 sec long or if you got an orally "ok" by one of the bandmembers. But it is ILLEGAL! I don’t believe there is anybody who doesn’t know that. Except for a few pre-school children and maybe people who have spent the last five years as alien abductees. That’s of course also illegal. Come on, don’t say you didn’t know that… /Svante — "We start a little bit quieter, move little bit onwards, and in the end we will send you home… deaf" – Jon Lord

Some of you might remember that I struggled with a couple of problems due to the MP3 sequences I had online at my bootleg archive, see my page www.black-sabbath.de for more details. The international record industry – better to say their organisation called IFPI, see www.ifpi.org – was aiming to send their lawyers after me, not very nice. Well, after that I was doing researches because I want to re-open the MP3-tracks on my page. I contacted the GEMA (which is the national group here in Germany where you pay money in order to use certain songs, in other countries it is called BIEM, STEMRA and so on). What I’ve found out – fact is: it is illegal to use copyright protected music online, no matter how long it is. As soon as one can notify an individual melody you do have to pay. This means eg that you can use some snippets of the guitar solo on Paranoid, but you are not allowed to put the main riff online nor the whole song. I tell this to all webmasters out there who have music online: think twice what you are doing. I faced an enourmous fee and only escaped it by big luck. It is illegal to use Black Sabbath music, it is illegal to put a link to illegal mp3s on your page, Black Sabbath/Ozzy/Dio, they all are under contract, the rights to most of their records are sold: they can not allow you to use their music online. The fee for using legally a track online is 25,- EURO/23,- USD in Germany for one year when you have a private page and less than 2,000 people are using that track monthly. I think I will pay for the track "Paranoid" for one year, this one can be found on any Black Sabbath bootleg. So I can put it online complete and people can check the quality of these bootlegs.
